Supreme Court of India has issued notice to UP CIC (Chief Information Commissioner) Justice (Retd) Mohammad Asgar Khan for making irregular appointments, and has asked him to respond within 6 weeks. The judgment has come against the Mayawati government's reference under the RTI Act seeking his dismissal for making irregular appointments and rendering other commissioners non-functional.
 
Apparently, the reference was made under RTI (Right to Information) Act, Section 17 by the Governor T V Rajeswar on July 10 to the Supreme Court. The charge on UP CIC is that he appointed 40 employees of class III/IV grade without advertising the posts. The action debarred other commissioners to discharge their functions. Also, CIC acted as if he was an appellate authority
 
A bench comprising Chief Justice K G Balakrishnan and Justices P Sathasivam and J M Panchal heard the arguments from State Additional Advocate General Shail Kumar Dwivedi and sent notice to CIC Justice Khan to respond within six weeks of time. According to Advocate Dwivedi the state government can take action against J. Khan only after the SC's inquiry conduction and conclusive proof of CIC being guilty.
