Top cops allegedly involved in Rizwanur murder case including IPS officer Ajoy Kumar, ACP Sukanti Chakraborty and SI Krishnendu Das have been arrested. All the three have been sent to jail for a fortnight on Tuesday. Interestingly, all three officers could be suspended if they stay in custody for 48 hours. Also, it was the first case in Bengal where an IPS was sent to jail.
All the three accused officers surrendered in front of 14th Metropolitan Magistrate’s court. The Metropolitan Magistrate Madhumita Roy turned down the prayer from the accused and sent them to jail custody. The situation was embarrassing and pitiful for senior police officers. All of them were exploring legal options to bail out their colleagues.
Later on, counsel for police officers petitioned in CMM (Chief Metropolitan Magistrate) court. CMM court on the other hand held that it does not have jurisdiction to examine the legality of the 14th court's order. The court observed that only the appellate court or the division Bench can hear the petition again. The CMM held that there was no case of miscarriage of justice on the face of facts, and hence the petition is rejected.
