In a significant statement given in an interview to leading news channel of India, Chief Information Commissioner Wajahat Habibullah has remarked that the judiciary too falls under the purview of the Right to Information Act. Habibullah’s statement gains importance as recently the Chief Justice of India, KG Balakrishnan remarked that it was ‘debatable’ whether the judiciary comes under the purview of the act.

Wajahat Habibullah in the interview asserted that the Right To Information Act applies to all the organs of the Government and all Constitutional bodies, which includes the legislature, executive and the judiciary. He added that he does not want to indulge in any kind of fight with the judiciary but differences are bound to occur between the two bodies. Habibullah’s crucial statement comes just before a full bench of the Central Information Commission studies whether the judiciary is under the RTI Act’s purview.
